1. Definitions
“Products”: Fruit-flavoured powdered drink mixes marketed under the Waterade brand.
“Customer”: Any person or business purchasing Products from us.
“Consumer”: An individual acting for purposes wholly or mainly outside their trade or
business.
“Business Customer”: Any customer acting in the course of business.
“Contract”: The agreement between the Customer and us.
2. Basis of Sale
2.1 These Terms apply to all sales via website, telephone, or email.
2.2 By placing an order, the Customer agrees to these Terms.
2.3 These Terms override any terms proposed by the Customer unless agreed in writing.
3. Product Information
3.1 Products are powdered fruit-flavoured drinks with added vitamins and sweetened with
stevia (no added sugar).
3.2 Descriptions and images are for guidance only.
3.3 Customers must ensure suitability for dietary needs.
4. Orders
4.1 Consumers: Orders via website; contract formed upon confirmation email.
4.2 Business Customers: Orders via telephone/email; contract formed upon acceptance.
4.3 We may refuse or cancel orders.
5. Pricing
5.1 Prices in GBP.
5.2 Consumers: Prices include VAT.
5.3 Business Customers: Prices exclude VAT unless stated.
5.4 Delivery charges apply.
5.5 Prices may change before order acceptance.
6. Payment
6.1 Consumers: Payment at checkout.
6.2 Business Customers: Payment terms agreed (e.g. 30 days).
6.3 Late payments may incur statutory interest.
6.4 We may suspend supply for non-payment.
7. Delivery
7.1 Delivery dates are estimates.
7.2 Risk passes on delivery.
7.3 Customers must inspect goods and report issues within 48 hours.
8. Title
8.1 Ownership remains with us until full payment is received (Business Customers).
8.2 Consumers gain ownership on delivery.
9. Returns and Cancellation
9.1 Consumers: 14-day cancellation right under Consumer Contracts Regulations.
9.2 Goods must be unused and in original packaging.
9.3 Refunds processed within 14 days of return.
9.4 Business returns only by agreement.
10. Product Use
10.1 Products must be prepared according to instructions.
10.2 Customers responsible for allergies and medical conditions.
11. Liability
11.1 Nothing excludes liability for death or personal injury caused by negligence.
11.2 Consumers: liable for foreseeable losses.
11.3 Business Customers: liability limited to purchase price.
11.4 No liability for indirect losses.
12. Compliance
Products comply with UK food safety regulations.
13. Force Majeure
We are not liable for events beyond our control.
14. Termination
We may terminate supply for breach, insolvency, or non-payment.
15. Intellectual Property
All branding remains our property.
16. Data Protection
We comply with UK data protection laws.
17. Governing Law
England and Wales.
18. General
Invalid provisions do not affect the remainder.
